Duncan & Prudence hope to make your online shopping experience as close to the one you'll get at our street address, which means you should have exactly the same expectations and guarantees of acceptable quality buying our stuff online as you would from our Riddiford Street store.

As a retailer and manufacturer of the goods you're purchasing, we are bound by the Consumer Guarantees Act to assure your basic rights to a product free from defects, that is safe and durable, and that corresponds to the description and measurements we specified.

Should your product arrive to you damaged or with some defect, we can fix it or replace it at no extra cost to you, and within our normal production schedules once we receive the returned damaged product for assessment.

Section 01

The terms of use for this site explain our legal responsibilities to each other, you as the user and/or purchaser, and Duncan & Prudence Ltd, the company that has created this website duncanprudence.co.nz. These terms create a legal agreement between you and us that covers everything you do on the site, and everything we provide and make available to you on this site. You are also protected by the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Sale of Goods Act 1994 and the Commerce Act 1986.

When you use the Duncan & Prudence site you are subject to the policies and any separate terms and conditions we may publish from time to time on this site. They will provide important additional information, terms or guidelines relating to your use, and they are outlined below in the legal section.

By using this site you are confirming to Duncan & Prudence that you accept these terms. We can change the Duncan & Prudence terms at any time or without notice to you. If we do this, any changes will take effect as soon as they are posted on this site. To help you become aware of any changes we will tell you about them in our newsletter and we’ll also include the date of any changes when we repost the terms. It’s up to you to remain aware of any updates to the terms, and whenever you use duncanprudence.co.nz you are confirming that you accept the latest updated Duncan & Prudence Terms of Use.

These terms are governed by and to be interpreted in accordance with New Zealand law. In the event of any dispute arising in relation to these terms or their subject matter, the New Zealand courts will have non-exclusive jurisdiction over such dispute.

Section 02

Duncanprudence.co.nz is a New Zealand web site, but anyone can shop at the site provided they are the authorised holder of a Visa or Mastercard credit card.

Duncan & Prudence provide customers outside of Newtown Wellington a survey of their clothing products, and then also provide a chance for them to purchase a small selection of these products online. Users also have the chance to contact Duncan & Prudence through the site in order to purchase products that are not available on the site, on a case by case basis.

Duncan & Prudence have done their best to make sure the information we provide about all our products is accurate, reliable, adequate, complete and current. If you buy a product online from duncanprudence.co.nz and it does not meet the product description, you are able to return it to Duncan & Prudence in an unused condition, and we will replace it with the product you specified.

All prices are stated in New Zealand dollars. To customers purchasing online in New Zealand, we incur the usual GST within the prices stated throughout the website. For customers purchasing online outside New Zealand, the amount that would usually account for GST has been allotted to maintaining and upgrading this website over time. This means customers purchasing our products from anywhere in the world will pay the same amount for their product.

All products purchased on duncanprudence.co.nz will incur delivery fees. These fees will be calculated and shown to you in the shopping cart before you complete your purchase.

Once an order has been placed and your payment has been processed, it cannot be changed or cancelled by you without our express consent. Duncan & Prudence reserve the right to cancel any order and repay any amounts paid by you for the cancelled order.

Duncan & Prudence accept VISA and MASTERCARD credit cards issued to authorised users only. All credit card transactions are charged in New Zealand dollars. If you contact Duncan & Prudence via email through the website, you can negotiate further payment options directly with us, such as bank transfers or cheques, but these other payment options will slow down the processing and delivery of your online order.

We use Paypal for all online credit card purchasing, which provides a secure payment service to you as card holder and also a secure payment tracking service for Duncan & Prudence. Your credit card is charged at the time you place your order, when you confirm your order and authorise us to debit your card.

If your credit card payment is declined you can authorise Duncan & Prudence to try and debit your card again or if you are the authorised holder of another eligible card, you may enter the new card details and ask us to debit this alternative credit card. We cannot retry your credit card for you without your authorisation, and this might delay the processing and delivery of your order.

Duncan & Prudence use Courierpost overnight delivery service for customers inside New Zealand, and DHL delivery services for customers outside New Zealand. Customers outside New Zealand can choose either Global Mail or Express Package rates. All postage and handling charges will be shown to you before confirming your payment. Charges are calculated per item.

If you wish to return a product you have purchased online, or cancel an order you have already made online, you must contact Duncan & Prudence either by email or phone. No cancellations can be made once an item has been despatched and is on its way to you. There are no returns on products that are the wrong size.

All product colours shown on duncanprudence.co.nz are as accurate as we can possibly get them, but due to the quality of computer screens and pixel resolutions, may change from computer to computer. Customers should view the site on more than one computer if unsure of our colour combinations, before placing order. There are no returns for product colours that don’t match colours on computer screens.

Section 03

You agree to comply with all laws and regulations applicable to your access and use of duncanprudence.co.nz. This means you agree to:

  • follow our instructions when using our site
  • not use the site inappropriately or unreasonably, such as sending spam, message bombs, abusive or defamatory, menacing or malicious messages, interfering with anyone's rights, collecting information about others, creating a false identity, making fake transactions, committing credit card fraud or transmitting or uploading material which breaches our intellectual property rights.
  • Use duncanprudence.co.nz only for lawful purposes, without annoying anyone or affecting anyone else's use of duncanprudence.co.nz and only as reasonably intended.
  • Not act in a way or use or attempt to damage, interfere with or introduce anything (including without limitation any virus, spider, robot, scraper or other automated means to access this website or feature on it that in any way compromises Duncan & Prudence Ltd.
  • Not use our website or copy, scrape, systematically or automatically extract or otherwise use any information or other material from the website for any commercial purpose other than to conduct a transaction where this is offered to you as part of our services.
  • Ensure that everyone you are responsible for also meets these commitments and your other obligations under these Terms.

Without limiting our other rights and remedies we may, at our discretion:

  • Monitor your use of duncanprudence.co.nz and restrict access to any content that we consider to be inappropriate or in breach of any law, third party right or these terms but we are not obliged to or responsible for doing so.
  • Contact law enforcement authorities if we believe that anything unlawful is occurring or has occurred in relation to duncanprudence.co.nz (including but not limited to the uploading or emailing of any material in breach of these terms or any applicable laws).
  • Provide copies of any relevant material to the law enforcement authorities and also give them access to any personal data that is held by us and relate to the material supplied.
  • Refuse to provide any further services to anyone who breaches these terms.

You cannot create links from this website or to this website from any external website without our prior written permission.

We are committed to looking after this site, and making it as accessable and lovely as we can for all our customers. We own all proprietary and intellectual property rights in and to our website and material displayed here including without limitation text, images, graphics, layout, look and feel, software, trademarks, trade names and other material underlying and forming part of our website. You may not copy, distribute, alter or tamper with in any way or otherwise use any material contained in our website except as set out in these terms.

At any time and without notice we might change the format and content of our website and/or any products or services offered here, or end or restrict your access to the service we provide if you do not meet any responsibility you have to us.

Whenever you visit duncanprudence.co.nz or send emails to us you are communicating with us electronically and thereby consent to receive communications from us electronically. We will communicate with you by email or by posting notices on our newsletter. You agree that all electronic communication we provide to you satisfies any legal requirements that such communications be in writing.

Personal information provided to us by you through your use of duncanprudence.co.nz is subject to our Privacy Policy, which forms part of these terms. You need to make sure that all information you give to us is correct and complete, and each time you provide information to us, you will be taken as confirming that you are authorised and capable of doing so.Without limiting our Privacy Policy, you agree that we may at any time disclose your personal information including, without limitation, your name and contact details to the relevant authorities if we consider that you are in breach of these Terms.

These terms constitute the entire agreement, and supersede any other agreements or understandings (oral or written) between you and us with respect to the subject matter.Each part of these Terms is separately binding. If for any reason any part cannot be relied upon, all other parts remain binding.

privacy policy

By "we" or "us" or “our” we mean Duncan & Prudence Ltd. Anytime we say "you" we mean the user and/or customer using duncanprudence.co.nz.

We will ask you directly for information about yourself when you purchase products, and we will also keep records of your email address and enquiries for later reference as a customer profile.

We will not receive or hold your credit card details. We use Paypal, who receive and process your credit card payments with its own payment page secured by its own SSL certificate. Your credit card details are stored by Paypal and only transmitted to the appropriate credit card agency for processing. We will only receive the first six and last two digits of a credit card in order to manage your order.

By choosing to use duncanprudence.co.nz, you give us permission to use and collect information about you, that we collect during your transaction with us online. We will only disclose your information for legal reasons if we decide you have been in breach of the Terms laid out in this agreement.

Under the privacy Act 1993 you have the right to ask to see the information we hold about you. We may update or revise this policy at any time and post these changes here to take effect as soon as they are posted. You accept our current policy each time you use duncanprudence.co.nz.
